- Hate speech or discriminatory content
- Violence or terrorist-related content
- Content that violates privacy rights
6.4 Resource Abuse
- Excessive CPU or bandwidth usage affecting server performance
- Running scripts that consume excessive resources
- File storage services or backup solutions (unless specifically allowed)
Violation of these policies may result in immediate suspension or termination of your account without refund.
7. Uptime Guarantee
NebeluRw strives to provide 99.9% uptime for our hosting services.
7.1 Service Level Agreement
- We guarantee 99.9% network uptime
- Scheduled maintenance is excluded from uptime calculations
- Downtime caused by factors outside our control is excluded
7.2 Service Credits
If uptime falls below 99.9% in any given month:
- 99.5% - 99.8% uptime: 10% service credit
- 99.0% - 99.4% uptime: 25% service credit
- Below 99.0% uptime: 50% service credit
Service credits must be claimed within 7 days of the incident and will be applied to your next invoice.
8. Data and Backups
8.1 Your Data
- You retain all rights to your content and data
- You are responsible for the content you host on our servers
- We do not claim ownership of your data
8.2 Backup Policy
- We perform regular automated backups of server data
- Backups are for disaster recovery purposes only
- We do not guarantee backup availability or data recovery
- You are responsible for maintaining your own backups
8.3 Data Loss
NebeluRw is not liable for any data loss. We strongly recommend that you:
- Maintain regular backups of your data
- Use version control systems
- Store critical data in multiple locations
9. Suspension and Termination
9.1 Suspension by NebeluRw
We may suspend your account immediately if:
- You violate these Terms of Service
- Your account is used for prohibited activities
- Payment is overdue
- Your activities threaten server security or performance
- We receive a legal request or court order
9.2 Termination by You
- You may cancel your service at any time through the client portal
- Cancellation takes effect at the end of your current billing period
- No refunds for partial months unless covered by our refund policy
- You must download your data before termination
9.3 Termination by NebeluRw
- We may terminate your account for violations of these Terms
- 30 days' notice will be provided for non-payment terminations
- No notice is required for serious violations (illegal activity, security threats)
- Terminated accounts may not be eligible for refunds
9.4 Effect of Termination
Upon termination:
- Access to your hosting account will be disabled
- Data may be deleted after 30 days
- Outstanding fees remain due and payable
10. Limitation of Liability
10.1 Service Disclaimer
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied.
10.2 Liability Limitations
To the maximum extent permitted by law, NebeluRw shall not be liable for:
- Loss of data, profits, or business opportunities
- Service interruptions or downtime
- Unauthorized access to your account
- Actions of third parties
- Force majeure events (natural disasters, wars, etc.)
10.3 Maximum Liability
Our total liability for any claim shall not exceed the amount you paid for the service in the 12 months preceding the claim.
10.4 Indemnification
You agree to indemnify and hold NebeluRw harmless from any claims, damages, or expenses arising from:
- Your use of our services
- Your violation of these Terms
- Content you host on our servers
- Your violation of any third-party rights
11. Intellectual Property

- The NebeluRw name, logo, and branding are our trademarks
- Website design, software, and content are protected by copyright

- You retain all rights to content you upload or create

12. Modifications to Terms

- Continued use of services constitutes acceptance of modified Terms
- You may terminate your account if you disagree with changes
13. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Rwanda. Any disputes arising from these Terms or our services shall be resolved through:
- Good faith negotiations between the parties
- Mediation, if negotiations fail
- The courts of Rwanda, as a last resort
